Terms of Service for Lab

1. Introduction

Welcome to Lab, a community platform operated by Hungry Dog Studios Ltd (“we,” “us,” or “our”). By accessing or using Lab, including our website and mobile application (collectively, the “Service”), you agree to comply with and be bound by these Terms of Service (“Terms”). 

These Terms incorporate our Privacy Policy, Cookie Policy, and any referenced documents, collectively governing access to the Lab platform.

If you do not agree to these Terms, please do not use the Service.

2. The Service

Lab provides an online community and course platform designed to allow content creators (“Creators”) to create and sell courses, coaching offerings and other services to their end users (“Students”). Lab provides each Creator with a dedicated environment (”Lab”) to host and offer their services. 

3. Relationship between Lab and Users

Lab is neither a content provider nor an educational institution. Creators and Students are not employees of Lab. 

Lab is not responsible for interactions between Creators and Students, except for providing the technological means through which Creators may broadcast and distribute their courses and other content (collectively, “Creator Content”). Lab does not endorse, monitor, or verify the quality, accuracy, or reliability of any Creator Content. Lab is not liable for any disputes, claims, losses, injuries, or damages of any kind that may arise from the Creator-Student relationship, including but not limited to a Student’s reliance on any information provided by a Creator or Creator Content.

As stated in our Privacy Policy, Lab provides Creators with limited information about Students enrolled in their services, including their name, email address, phone number, and the Creator offering in which the Student has enrolled. This information is only accessible to the Creator upon a Student’s purchase or enrollment. Lab does not sell, rent, release, disclose, or otherwise transfer Student data to Creators for monetary or other valuable consideration. Students assume full responsibility for the disclosure and use of any additional personal information they choose to share with a Creator on the Service.

4. Eligibility

To use the Service, you must be at least 13 years old. By accessing or using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. User Accounts

• Registration: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account. 

6. Acceptable Use

You agree to use the Service in accordance with all applicable laws and regulations. You further agree not to:

• Use the Service for any unlawful or fraudulent purposes.

• Harass, abuse, or harm another person or group.

• Impersonate any person or entity or misrepresent your affiliation with a person or entity.

• Interfere with or disrupt the integrity or performance of the Service.

• Attempt to gain unauthorized access to the Service or its related systems or networks.

• Post or transmit any content that is illegal, harmful, or violates the rights of others.

7. User Content

• Ownership: You retain ownership of any content you post, upload, or otherwise make available through the Service (“User Content”). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

• Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the above license and that your User Content does not violate any laws or infringe the rights of any third party.

• Review: Lab may review User Content for any reason, including compliance with our Acceptable Use and prohibited content requirements, but Lab has no obligation to review anything that you upload.

8. Intellectual Property

• Our Content: The Service and its original content, features, and functionality are and will remain the exclusive property of Hungry Dog Studios Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries.

• Feedback: If you provide us with any feedback or suggestions regarding the Service, you grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, and royalty-free right to use such feedback or suggestions for any purpose without any obligation to you.

9. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Payments and Fees

All payments made through the Service are processed by Stripe, our third-party payment processor. By using Lab, you agree to comply with Stripe’s Terms of Service and Privacy Policy. Lab does not store, process, or have access to your payment details.

11. Refund Policy

Creators

Creators on the Pro plan are entitled to a full, no-questions-asked refund within thirty (30) days of first signing up. To request a refund, you must notify us in writing within this period. After cancellation, the Creator account will revert to the Basic plan.

Lab reserves the right to refuse refunds to Creators who abuse this Refund Policy. Examples of abuse include, but are not limited to, requesting refunds for multiple schools or requesting refunds in consecutive months.

If a Creator experiences a platform failure that significantly impacts their ability to use the Service (e.g., extended downtime, major technical issues preventing course delivery), they may request a refund. These refund requests will be reviewed on a case-by-case basis and are granted at Lab’s sole discretion. Creators must provide detailed information about the issue and any supporting documentation when submitting a request.

Students

Since course content is digital and accessible immediately upon purchase, all sales are final and non-refundable. Students enrolled in subscription-based courses may cancel their subscriptions at any time, but past payments are non-refundable.

Refund requests relating to a Creator’s course are at the sole discretion of the Creator. Creators may set their own refund policies for their courses, provided they clearly communicate them to Students. To set up a custom refund policy, Creators must include it in their course descriptions or Terms on their Lab page. Lab is not responsible for enforcing or mediating Creator-specific refund policies.

However, in exceptional circumstances, such as payment processing errors or platform access issues, Lab may issue refunds at its discretion.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

13. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by law, in no event shall Hungry Dog Studios Ltd, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in accordance with the laws of England and Wales.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect via email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
